Welcome to Haiduk (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of behaiduk.com (the “Site”) and any purchases made through it. By accessing the Site or placing an order, you agree to these Terms.

If you do not agree, please do not use the Site.

Eligibility and account

You must be at least the age of majority in your country/region to place an order.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current information and to keep it updated.

Products and availability

We sell clothing and related items. We try to display products, sizes, colors, materials, and availability as accurately as possible. However:

  • Product images are illustrative and may vary slightly from the actual product due to lighting and screen differences.
  • Measurements and fit guidance are approximate; slight variations can occur between production batches.
  • We may update product details or discontinue items at any time.

Prices, currency, and taxes

All prices are shown in RSD and are inclusive of applicable taxes unless stated otherwise. Any applicable taxes are calculated and displayed at checkout before you place your order.

We reserve the right to change prices at any time. Price changes do not affect orders already accepted.

Orders and acceptance

Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion, including in cases of:

  • suspected fraud or unauthorized activity,
  • product availability issues,
  • errors in pricing or product information.

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method, unless otherwise required by law.

Payment

We accept the payment methods shown at checkout. Payments are processed securely by third-party payment providers. We do not store full payment card details.

If a payment is reversed, charged back, or otherwise invalidated, we may suspend fulfillment, restrict account access, and/or take steps permitted by law to recover amounts owed.

Promotions and discount codes

Discount codes and promotions:

  • must be applied at checkout and cannot be applied retroactively,
  • may be limited to specific products, categories, minimum spend, or time periods,
  • cannot be exchanged for cash,
  • may be modified or withdrawn at any time.

We may refuse the use of a discount code if we reasonably believe it is being misused or used fraudulently.

Intellectual property

All content on the Site—including text, product names, photos, graphics, logos, and design—is owned by or licensed to Haiduk and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, display, or exploit any Site content without our prior written permission.

User content and reviews

If you submit reviews, comments, images, or other content (“User Content”), you confirm that:

  • you own the rights to the content or have permission to share it,
  • it does not violate any laws or third-party rights (including privacy and intellectual property),
  • it is not false, misleading, abusive, or defamatory.

You grant Haiduk a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content in connection with operating and promoting the Site, including marketing, unless prohibited by law.

We may remove User Content at our discretion.

Prohibited use

You agree not to:

  • use the Site for unlawful purposes,
  • attempt unauthorized access to the Site, accounts, or systems,
  • introduce malware or harmful code,
  • scrape, harvest, reverse engineer, or interfere with the Site’s operation,
  • impersonate another person or provide false information.

Disclaimer

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, or that product information will always be complete or current.

Nothing in these Terms affects non-excludable consumer guarantees or statutory rights.

Limitation of liability

To the maximum extent permitted by law:

Haiduk will not be liable for indirect, incidental, special, or consequential losses (including loss of profits, revenue, data, or goodwill).

Our total liability for any claim relating to a product or order is limited to the amount you paid for the relevant product(s).

This section does not limit liability where it cannot be limited by law (for example, for intentional misconduct, or death/personal injury caused by negligence, where applicable).

Privacy

Your use of the Site is also governed by our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above indicates when these Terms were most recently revised. Updated Terms apply from the moment they are posted on the Site.

Governing law and disputes

These Terms are governed by the laws of Serbia, without regard to conflict of law rules.

If you are a consumer, you may have the benefit of mandatory consumer protection laws in your country/region that cannot be excluded.

Any disputes will be handled by the competent courts in Serbia, unless applicable law requires otherwise.
